Additional legal context: Pennsylvania’s public trust doctrine

Article I, Section 27 of the Pennsylvania Constitution protects the people’s rights to clean air, pure water, and environmental preservation, and places Pennsylvania’s public natural resources in trust for current and future generations.

In Pennsylvania Environmental Defense Foundation v. Commonwealth, 161 A.3d 911 (Pa. 2017), the Pennsylvania Supreme Court described the Commonwealth’s duty to conserve and maintain public natural resources. That case concerned state forest and park lands, not this private data-center proposal. Section 27 may be a legal framework for counsel to assess when government decisions could affect qualifying public resources; it does not automatically prohibit a private development or establish that a violation has occurred.

This is general legal background, not legal advice. Whether Section 27 applies to a specific Project Gold approval depends on the resources and government actions involved and should be assessed by qualified Pennsylvania counsel.
